This is a collection policy for the Bethany Mews Homeowners' Association, a single-family home HOA in Allen, TX. It outlines the timeline and penalties for delinquent assessments, applying to all homeowners in the association. This document does not contain the full CC&Rs or other rules like architectural guidelines, pet restrictions, or noise limits.
- Assessment due dates & delinquency: Assessments are due annually on January 1. They become delinquent 30 days later (January 31).
- Late fees: If an assessment is not paid within 45 days of the due date, a $25 late fee is added, and an additional $25 is charged every 30 days until paid in full.
- Notices & suspension of privileges: After 45 days delinquent, the Association may send a Notice of Late Payment, and after 75 days delinquent a Notice of Default. Owners not in good standing after 45 days may have their use of common properties suspended (including for family members) until the delinquency is cured.
- Liens & legal action: Ninety days after the Notice of Default, legal counsel may file a Notice of Lien and/or a lawsuit to recover outstanding amounts plus attorney's fees and costs. Continued delinquency can lead to foreclosure at the Board's discretion.
