Cartwright Mays is a standard single-family home HOA in Kaufman County, Texas. The rules apply to all lot owners and residents. The document is the master Declaration of Covenants, Conditions and Restrictions (CC&Rs) that governs use, maintenance, construction, and assessments.
- Single-family residential use: All lots are for single-family residential use only. No professional, business, or commercial activity inviting the public is allowed, though limited home-based businesses are permitted if they comply with applicable law and use only resident occupants.
- Leasing & rentals: Rentals must be for residential purposes only, with a minimum lease term of at least six months. Leases must be in writing, and the owner must provide copies of the restrictions to the tenant and notify the association within 10 days of the lease effective date.
- Pets: No more than three cats and dogs in the aggregate per lot. Pets must be registered, licensed, and vaccinated as required by law. The board may determine if a pet is a domestic household pet; exotic animals are prohibited. Pets must not be a nuisance and must be cleaned up after.
- Parking & vehicles: No parking on streets, sidewalks, or common area except for temporary parking (up to 72 hours). Recreational vehicles, boats, trailers, and commercial vehicles are generally prohibited, with limited exceptions during certain weekends. Basketball goals must be set back at least 10 feet from the curb.
- Architectural review: All exterior improvements, including construction, modifications, fences, roofing, solar devices, rainwater harvesting, and xeriscaping, require prior written approval from the Architectural Control Committee (ACC). The ACC has sole discretion to approve or deny plans.
- Signs & flags: Signs are heavily restricted. Allowed: one temporary 'For Sale' sign (professional, max 5 sq ft, ground-mounted), political signs (certain time limits), and a few others. 'For Rent' signs are prohibited. Flags: up to one freestanding flagpole (max 20 ft) or two mounted flagpoles, displaying only the U.S., Texas, or military flags (max 3x5 ft).
- Assessments & membership: Every lot owner automatically becomes a member of the association and must pay assessments (regular, special, and working capital). Assessments are a lien on the lot. The board may suspend common area use for nonpayment. The declarant retains special rights during the development period.
- District taxes: The property is within the Kaufman County Fresh Water Supply District No. 1, which imposes taxes for water, sewer, drainage, and road facilities. Owners must pay the applicable district tax rate and provide notice of the district upon property transfer.
