This document is a notice of filing for multiple policies of the Cimarron Residential Association, Inc., a standard single-family homeowners association (HOA) in Allen, TX. It does not contain the full Declaration of Covenants, Conditions, and Restrictions, but rather nine attached policies that govern specific topics. The rules described below apply to all homeowners in the subdivision.
- Flag display: You may display the U.S. flag, Texas flag, or a replica flag of any U.S. armed forces branch. Flagpole height max 20 ft, only one flagpole per property, flag max size 3' x 5'. Ground-mounted lights must screen the bulb and not exceed 300W equivalent. Flags must be in good condition, and flagpoles must not create excessive noise (e.g., use vinyl or plastic snap hooks).
- Payment plan for delinquent assessments: If you are delinquent, you may request a 6-month payment plan. You must submit a signed agreement and pay 25% of the delinquent amount initially. Remaining installments are due monthly. A monthly monitoring fee of at least $5 applies, plus interest. If you default, the Association can proceed with collection and add attorneys' fees.
- Rainwater recovery devices: Rain barrels or rainwater harvesting systems are allowed, but must be installed in side or rear yards (not in front of the home). They must match the home's color scheme and cannot be on common property. Prior written approval from the Board or architectural committee is required, including plans showing location, color, size, and visibility.
- Religious item display: You may display religious items at the entry door or door frame, but the total size cannot exceed 25 square inches. Items cannot threaten health or safety, violate law, or contain patently offensive content. No prior approval is needed if the items comply with these guidelines.
- Roofing materials: The Association cannot prohibit shingles that are wind- and hail-resistant, provide greater energy efficiency, have solar capabilities, and resemble neighborhood shingles, provided they are of equal or superior quality and match the aesthetics of surrounding properties.
- Solar energy devices: Solar panels or devices may be installed on the roof or within a fenced yard/patio with advance approval. Roof-mounted units must not extend beyond the roofline and must be parallel to the ridge; colors must match the roof or be silver/bronze/black. Yard-mounted devices must not extend above the fence and must be screened from view. Unused inoperable devices visible from a street or common area must be removed.
- Document access and fees: Owners may request to inspect or copy Association books and records. Requests must be in writing. The Association must respond within 10 business days. Copy costs: $0.10 per page for standard copies, plus $15/hour labor, 20% overhead on labor (waived for ≤50 pages), and shipping. The Association may require advance payment of estimated costs.
- Assessment collection timeline and fees: Assessments are due semi-annually on January 1 and July 1. Delinquent after 30 days. A $25 late fee accrues every 30 days after 45 days past due. At 60 days, a $25 handling fee is added. At 90 days, the account is referred to an attorney. At 120 days, a lien may be filed. Foreclosure may be considered for continued delinquency.
