What Cross Creek East's governing documents say
Cross Creek East is a single-family home subdivision in Allen, TX (Collin County), governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs). These rules apply to lot owners and occupants, establishing a uniform plan for residential use and property maintenance. The document is for a standard HOA, not a condominium or townhome community.
- Single-family residential use: Lots may be used only for single-family residential purposes. No business, commercial, or manufacturing activity is allowed, and no mobile homes, trailers, or temporary structures (except for model homes during construction).
- Minimum square footage & construction standards: Dwellings must have at least 1,200 square feet of livable area (excludes open porches, garages, carports). At least 50% of the first-floor wall area (to top of first-floor window height) must be masonry, masonry veneer, or stucco unless otherwise approved by the ACC.
- Architectural review (ACC): All construction, alterations, and improvements require prior written approval from an Architectural Control Committee (ACC). Plans and specifications must be submitted; if the ACC fails to act within 30 days, approval is deemed granted. The ACC's powers terminate 5 years after the declaration was recorded.
- Setbacks & location: Houses on corner lots must be set back at least 10 feet from the side street lot line. Setbacks from front and side lot lines are determined by the recorded plat. The building site must have at least 60 feet of frontage at the setback line.
- Vehicle & parking restrictions: No inoperable vehicles, or vehicles without current license plates and inspection stickers, may be parked or stored on a lot for more than 24 hours in any 72-hour period unless completely concealed inside a garage. Recreational vehicles, boats, trailers, and equipment are similarly restricted. Temporary construction vehicles are exempt.
- Signs & antennas: No signs, advertisements, or billboards are permitted except for builder signs during original construction. No electronic antenna or dish (other than normal radio/TV antennas) may be placed forward of the front building line or be visible from the street unless approved.
- Prohibited activities & nuisances: No noxious, offensive, or annoying activity may be conducted. The drying of clothes in public view is prohibited on corner lots or where rear yards are visible from public areas. Trash and waste must be stored out of public view in covered containers.
- What this document doesn't cover: This filing includes multiple 'Change of Beneficiary' amendments for a lender's mortgage, which do not affect homeowners' rights or obligations. The CC&Rs do not address HOA assessments, leasing restrictions, pet limits, or age restrictions.
