This is the Bylaws of the Sedona Owners Association, a Texas property owners association for Sedona Phase Two, a single-family residential subdivision in Frisco, Texas. It governs how the association is run—board elections, meetings, enforcement, and owner obligations—rather than day-to-day property rules. It applies to all lot owners in the community.
- Board & governance: The board has five directors after developer control ends, with staggered two-year terms. Directors must be members or residents, and cannot be delinquent on assessments or have uncured violations. The board manages the association and can adopt rules.
- Meetings & voting: Annual meetings are held, with special meetings called by the board or by petition of at least 20% of lot owners. A quorum is required, and most decisions pass by majority of votes cast. Proxies are allowed and expire after 11 months unless specified otherwise.
- Rules & enforcement: The board can adopt and amend reasonable rules for the property and residents, with at least 10 days' notice before changes take effect. Enforcement actions like fines or suspension of common-area use require written notice and a hearing, except in emergencies. Fines must be reasonable and cannot accrue interest.
- Owner obligations: Owners must notify the board before selling, provide proof of ownership, and keep their contact information current. They must comply with the governing documents and pay assessments. Owners are also required to provide information about mortgagees and maintain a mailing address.
- Association records: The association must keep books and records available for inspection by members for a proper purpose, and provide resale certificates upon request for a fee. It must also maintain a management certificate in county records.
