What Town Lake Residential Community, Inc.'s governing documents say
Town Lake is a single-family residential community (an HOA) governed by a Declaration and Community Manual. These documents are amendments and supplements to that rulebook — not the full set of rules. They cover new fence requirements, one-time fees on sale, fine schedules, hearing procedures, board notice rules, and certain statutory protections.
- Fence rules: All fences must be approved by the architectural committee. Fences must be 5 feet tall, made of wrought iron or powder-coated tubular steel, and cannot be placed closer to the street than the front wall of the house.
- One-time fees on purchase: Buyers who purchase directly from the developer pay a one-time $250 amenity reimbursement fee. Any buyer (including resale) pays a $1,500 working capital fee, unless the transfer is a foreclosure, to/from the association, or to a spouse/child/parent.
- Fines for rule violations: The association can fine for violations. For curable violations, fines escalate: $50, $100, $200, $400, $800, then $1,000 for subsequent. For uncurable or health/safety violations, the first fine is $100, rising to $1,000. The board can adjust amounts case-by-case.
- Violation hearing rights: If you get a violation notice, you can request a hearing within 30 days. The hearing must happen within 30 days of your request. The board must give you 10 days' notice and provide all evidence it will use; if not, you get a 15-day postponement.
- Board meeting notice: Regular board meetings require at least 144 hours' posted/e-mailed notice or 10–60 days' mailed notice. Special meetings need 72 hours' posted/e-mailed notice. Certain actions (fines, foreclosures, budget approval, etc.) must be done in open meetings with prior notice.
- Pool enclosures and security fences: Pool enclosures must be transparent mesh or clear panels in black metal frames, no higher than 6 feet. Front-yard security fencing is discouraged but if used must be ornamental iron, painted black, with specific dimensions (48–60 inches tall, pickets 3/4" square, etc.). All require approval.
- Religious displays: Owners may display religious items on their property if based on sincere religious belief, as long as they don't threaten health/safety, violate other laws, or contain patently offensive content. Items can't be placed on common areas or public infrastructure.
- Delinquent assessment protections: Before turning a delinquency over to a collection agent or reporting it to a credit bureau, the association must give written notice with at least 45 days to cure. It must also send a separate 30-business-days notice before reporting and cannot charge a fee for the reporting itself.
