- Notice of delinquency: The association will send a Notice of Delinquency via certified mail listing past due amounts and contact information for payment. A subsequent Notice of Default may follow, giving the owner 30 days to cure and informing them of the right to request a payment plan.
- Suspended privileges: If an owner remains delinquent past 45 days, the association may suspend the owner’s (and their family’s) right to use common properties. The owner receives a notice and an opportunity to request a hearing before the board before suspension takes effect.
- Hearing process: The owner may request a hearing within 30 days of the Notice of Default; the association may postpone the hearing up to 15 days. At the hearing, the board or a representative presents the association’s case, and the owner may present relevant information.
- What this document doesn't cover: This policy does not include the full Declaration of Covenants, Conditions, and Restrictions (CC&Rs), architectural guidelines, pet rules, rental restrictions, or other community rules. It only addresses assessment collection procedures.
