This is a partial, ancillary document for a single lot in Westover Ranch Subdivision (Argyle, TX) — a Restrictive Covenant and Agreement between the owner of Lot 7, Block B and the builder (Mearstone Properties). It is not a community-wide rulebook; it binds only that owner and the builder, addressing dispute resolution, warranty disclaimers, and mold liability, and it runs with the land.
- Dispute resolution (mediation & arbitration): Any dispute (contract, warranty, tort, etc.) between owner and builder must first go to mediation, and if not resolved, to binding arbitration under the Federal Arbitration Act. The filing of a court proceeding does not waive the right to arbitration, and the party violating this agreement must reimburse others' costs and attorneys' fees.
- Warranty disclaimers: The builder makes no implied warranties on the property or improvements (e.g., habitability, good workmanship) except as stated in the express written limited warranty from the sales contract. Any implied warranties that cannot be disclaimed are limited to two years from the date of conveyance.
- Mold and biological impurities: The builder disclaims all liability for mold, mildew, fungi, or biological impurities. The owner is responsible for maintenance (e.g., humidity control, leak repair, cleaning). For $50 and other consideration, the owner releases the builder from all present and future claims related to mold, including personal injury and property damage.
- Binding effect & running with the land: This agreement is binding on and inures to the benefit of the parties, their heirs, successors, and assigns, and it runs with the land—meaning future owners of the property are also bound.
