Rosewood Villas is a single-family home HOA in Colleyville, TX. These covenants and restrictions apply to all lot owners and residents, governing use, construction, and maintenance. The community is designed as a uniform residential subdivision with strict architectural controls.
- Residential use only: All lots must be used for single-family residential purposes only. No business, commerce, or professions are allowed. No oil drilling, mining, or industrial uses. Only one residence per lot.
- Minimum house size: One-story homes must have at least 2,200 sq ft of living area (exclusive of porches, garages). Two-story homes require at least 2,420 sq ft total with a minimum of 1,800 sq ft on the ground floor. Lots 19-42 require a minimum of 2,400 sq ft (one-story) or 2,640 sq ft (two-story). Lots 20-31 are restricted to one story only.
- Architectural review: All building plans, including exterior materials, colors, and landscaping, must be approved in writing by the Architectural Control Committee before construction. The committee has 15 working days to approve or disapprove; if no response, plans are deemed approved if they comply with restrictions. Exterior materials must be at least 80% brick, stone, or stucco.
- Landscaping & sprinklers: Each lot must have an underground sprinkler system covering front, side, and rear yards. Landscaping must be completed within 60 days of the house being 90% complete, including at least 3 trees (minimum 3-inch diameter) of approved varieties. All landscaping must be maintained in healthy condition.
- Parking & vehicles: No vehicles, boats, or equipment may be stored outside the garage. Garages must be used for parking all vehicles owned or controlled by the lot owner. Violating vehicles may be towed after agreement of three lot owners.
- Fences & walls: All fences must be approved in writing and constructed of brick, natural stone, cast concrete, or wrought iron. Front and street-facing fences must not exceed setback lines. On interior lots, fences up to 8 feet high are allowed between building lines. Side yard fences are subject to specific easements and maintenance responsibilities.
- HOA assessments & fees: The HOA may levy mandatory annual assessments for common area maintenance, including a $50 per lot annual street maintenance fund (adjustable). Additional fees may include mowing costs and a use fee for greenbelt areas not exceeding 5% of the annual maintenance fee. Late payments accrue 12% annual interest and can become a lien on the property.
- Enforcement & violation fees: Violations of restrictions trigger a $100 per day fee starting 31 days after written notice. The fee becomes a lien and personal obligation of the owner. The HOA or Declarant may also seek injunctions or damages.
