This is a set of amendments and supplemental declarations for Del Webb at Union Park, a master-planned single-family HOA community in Aubrey/Little Elm, Texas, developed by Pulte Homes. The documents amend the original Declaration of Covenants, Conditions and Restrictions (CC&Rs) and Design Guidelines, and they bind all homeowners in the community. The excerpts focus on parking and vehicle rules, architectural review, signs, religious displays, and the HOA's collection policy for unpaid assessments.
- Parking & vehicles: Vehicles must be parked in garages except for limited driveway parking. One passenger vehicle (car, motorcycle, van, pickup under 1 ton, or golf cart) may be parked in the driveway if it's operational and doesn't block the sidewalk. Commercial vehicles, RVs, boats, and trailers may be parked on driveways for up to 48 hours in any 7-day period. Guest cars may park on the street for up to 72 hours unless the Board grants an extension.
- Architectural review: Any exterior construction, alteration, or improvement (including landscaping that affects appearance) requires prior approval from the Architectural Reviewer. Interior changes that aren't visible from outside are allowed without approval. The Architectural Reviewer can evaluate anything that might affect the community's value or appearance.
- Signs: Signs are generally prohibited without approval, but there are exceptions: one small security sign (max 2 sq ft, within 5 ft of the front door), one 'For Sale'/'For Rent' sign (max 4 ft tall, must be removed within 2 working days after closing or listing termination), a small 'no soliciting' sign (max 5x7 inches), and political signs (ground-mounted, max 4x6 ft, only from 90 days before an election to 10 days after, one per candidate/issue).
- Religious displays: Owners and residents may display religious items motivated by sincere religious belief, but they cannot threaten public health or safety, violate laws, be patently offensive, encroach on easements, or be attached to traffic devices or utility fixtures. The HOA can remove displays that violate these rules.
- Firearms & fireworks: Unlawful discharge of firearms and any discharge of fireworks within the community is prohibited.
- Assessments & collections: Annual assessments are due by January 1 (or another date set by the Board). If not paid within 30 days, interest accrues at 18% per year and a $15 late charge is added. The HOA can send collection notices, charge all collection costs (including attorney fees) to the owner, and may foreclose on the property to collect unpaid assessments. Owners are offered payment plans as required by Texas law.
