This is a restrictive covenant and agreement between individual property owners and the builder (Sandlin Homes and its affiliates) for lots in Oak Harbor Estates, Azle, TX. It is not a community-wide homeowners association rulebook; it runs with the land and primarily governs dispute resolution and warranty disclaimers for the original and subsequent owners.
- Dispute resolution (arbitration & mediation): Any dispute between the owner and builder (including construction defects, warranty claims, fraud, etc.) must first go through mediation, then binding arbitration under the Federal Arbitration Act. Filing a court action does not waive arbitration; the court must order arbitration on motion. The arbitrator can award attorneys' fees.
- Waiver of implied warranties: All implied warranties (habitability, workmanlike construction, fitness) are disclaimed to the fullest extent allowed by law. If law does not permit full disclaimer, implied warranties are limited to 2 years from the date the builder conveyed the property. Only the express limited warranty provided by the builder applies.

Owner releases builder from all claims for property damage, personal injury, or other loss from mold or harmful organisms. Owner must inspect, maintain, and immediately address moisture sources; minor mold can be removed with bleach. Owner must obtain waivers of subrogation from insurers.
