What Fairmont Villas Homeowners's governing documents say
This is a restrictive covenant agreement recorded against an individual lot in the Fairmont Villas Addition (a single-family subdivision). It was signed between the builder (American Life Homes, Inc.) and the original buyer, and it runs with the land so it binds all future owners of that lot. It is not a full set of HOA rules; it primarily addresses dispute resolution, warranty limitations, and mold maintenance.
- Dispute resolution (mediation & arbitration): Any dispute arising from the purchase or construction of the home—including warranty, tort, or contract claims—must first go to mediation, then to binding arbitration (not court). The Federal Arbitration Act applies. The arbitrator can award attorneys' fees. Filing a court action does not waive the right to compel arbitration.
- Warranties & construction defects: The buyer waives all implied warranties (including good workmanship, merchantability, fitness) except the implied warranty of habitability. The only express warranty is a third-party limited warranty provided by the builder. Construction defect claims are governed by the Texas Residential Construction Liability Act (RCLA).
- Mold & biological impurities: The buyer assumes all maintenance responsibility to prevent mold and agrees the builder is not liable for any mold-related damages, injuries, or illnesses. The buyer releases the builder from all such claims and must obtain waivers of subrogation from their own insurer.
