This is a restrictive covenant agreement between a builder (Hampton Interests) and a homeowner for a specific lot in the Forum III B subdivision in Bedford/Grand Prairie, Texas. It is not a community-wide declaration of covenants, conditions, and restrictions (CC&Rs); it does not contain HOA rules about pets, leasing, fees, or property use. Instead, it primarily governs construction warranties, dispute resolution (mediation/arbitration), and disclaimers of implied warranties.
- Warranties & disclaimers: The builder provides only express written limited warranties; all implied warranties (including habitability, fitness for purpose, and workmanlike construction) are expressly disclaimed to the fullest extent permitted by law. Manufacturer warranties on equipment may be assigned to the owner.
- Dispute resolution (mediation/arbitration): Any dispute between builder and owner (or subsequent owners) related to the property or construction must first be mediated through the AAA, and if not resolved, submitted to binding arbitration under Title 9 of the U.S. Code or the Texas General Arbitration Act. The arbitrator decides costs and fees.
- Builder's liability for pools / third-party work: The builder has no responsibility for swimming pools or related work performed by the owner or a pool contractor; all warranties for pool work are disclaimed, and the owner indemnifies the builder against claims arising from pool construction or maintenance.
- Non-transferability of express warranties: The express warranties are personal to the original owner and become null and void upon any transfer of the property (voluntary or involuntary). They do not benefit subsequent owners, lessees, heirs, or assigns.
- Applicable law (RCLA and DTPA): The agreement acknowledges that the Texas Residential Construction Liability Act (RCLA) and the Deceptive Trade Practices Act (DTPA) apply; the RCLA controls to the extent of conflict. Owners must follow RCLA notice procedures for construction defects.
