What Monarch Hills Owners's governing documents say
Monarch Hills is a single-family home subdivision in Fort Worth, TX, governed by a homeowners association (HOA). These covenants, conditions, and restrictions apply to all lot owners and residents. The HOA enforces rules on property use, appearance, and behavior through a board and architectural control committee.
- Architectural review: Any exterior changes visible from the street or a neighbor's lot require prior written approval from the Architectural Control Committee (ACC). Plans must be submitted, and the ACC has 60 days to respond; if no response, a second request triggers a 45-day deemed approval. Approval does not relieve the owner from obtaining city permits.
- Animals: No more than four dogs and/or cats per lot unless rules specify otherwise. Pets must not disturb neighbors, and owners must clean up pet waste. The owner is liable for any damage or injury caused by the animal.
- Leasing & rentals: Owners may lease their homes but are responsible for tenant compliance with all documents. The owner is liable for violations by the tenant or guests and must enforce compliance or terminate the lease if violations continue.
- Vehicles & parking: Commercial vehicles, trucks over one ton, inoperable vehicles, and boats/trailers are prohibited from parking overnight or in driveways unless for temporary construction. Vehicles must be maintained and not be unsightly. The HOA may remove violating vehicles.
- Signs: No signs without ACC approval except for: for-sale/lease signs, security alarm signs, school activity signs, college/university support signs, and baby birth announcement signs (allowed for birth plus 7 days). Such signs must be two feet square or smaller and within eight feet of the front of the house.
- Basketball hoops & recreational equipment: Portable basketball hoops and other recreational equipment are allowed only if put out of sight when not in use. They may not be installed in front yards, driveways, unfenced side yards, or on street-side exterior walls without ACC approval.
- Fines & enforcement: Violations trigger a warning, then escalating fines: $20 (10 days to cure), $40 (10 days), then $100 every 10 days until compliance. The HOA may also levy individual assessments for cleanup costs, and nonpayment can result in a lien. Owners responsible for attorney fees if enforced.
- Dispute resolution: Disputes between owners or with the HOA must go through mandatory negotiation, mediation, and binding arbitration before any lawsuit. Costs are allocated as per the resolution.
