- Enforcement process: Violations are verified by a field observer, then the owner receives a courtesy notice with at least 10 days to correct the issue before a formal Notice of Violation is sent by certified mail. The owner may request a hearing within 30 days.
- Fines & schedule: Fines are assessed per the schedule in Exhibit A, with amounts like $200 for unapproved exterior improvements, $100 for trash not in accordance with city ordinances, $100 for parking boats/trailers/RVs, $200 for clotheslines or window AC units, and up to $100 for noise or animal control violations. Fines may repeat every 15 days until corrected.
- Repeat violations & discretion: The Board may adopt a progression of fines for repeat offenders, and fine amounts are reasonably related to the violation. The Board has final discretion in setting fines.
- Corrective action & costs: If a violation is not corrected, the Board may have the violation corrected, abated, or removed at the owner's expense. The owner is liable for all costs, and fines become the personal obligation of the unit owner.
- Collection & lien: Unpaid fines and costs may be presented to the Board as an individual assessment against the unit, becoming a personal obligation that can be collected.
