What Wilshire Substation's governing documents say
This is a restrictive covenant recorded by a developer to ensure permanent road access to an Oncor electrical substation. It binds only the current and future owners of the subject property (a 92.5-acre tract), not residents or homeowners. It is not a community rulebook and does not regulate how people live on the property.
- Obligation to construct roads: The Declarant (and its successors) must build South Wicker Hill Road and Bear Ridge Drive to connect Wilshire Boulevard or State Highway 174 to the substation tract, built to City of Burleson standards. The roads are shown on a preliminary plat (Exhibit C).
- Enforcement: Only Oncor (the electric company) has the right to enforce this covenant, by legal action to stop violations, compel performance, or recover damages. Oncor is not required to enforce it and failure to enforce does not waive its rights.
- Term & termination: The covenant runs with the land for 100 years from recording, automatically extending in 10-year periods. It terminates automatically once the roads are completed and dedicated as public roads, without any further action.
- Amendment: The covenant can only be amended by a written agreement signed by both the Declarant (or its successor) and Oncor.
- What this document doesn't cover: This document contains no rules about pets, leasing, age restrictions, architectural review, parking, or any other typical community living rules. It is a narrow covenant solely about road construction for utility access.
