This is a Declaration of Covenants, Conditions and Restrictions for Greenridge Estates, a single-family home community in Burleson, Texas. It establishes a homeowners' association (Greenridge Estates HOA) that governs use, maintenance, and architectural standards for all lots. The community is part of a larger master-planned development (Abby Burleson) with a master association that also imposes rules and assessments.
- Use restrictions (residential & business): All lots and dwellings must be used for single-family residential purposes only. Home-based businesses are allowed only if they are not detectable from outside, comply with zoning, involve minimal client visits, and remain ancillary to residential use—at the Board's sole discretion.
- Parking & vehicles: Only passenger automobiles, motorcycles, passenger vans, and pick-up trucks (under 1 ton capacity, less than 3 axles, operating condition, in daily use) may be parked in driveways visible from the street. No boats, trailers, campers, RVs, or commercial vehicles may be kept on lots unless fully enclosed in a garage or screened and approved. Abandoned or inoperable vehicles are prohibited.
- Architectural review: Any exterior construction, alteration, or landscaping requires prior written approval from the Architectural Control Authority (ACA). During the Development Period (until Declarant no longer owns lots), Declarant acts as ACA; afterward, a committee appointed by the Board. Plans must be submitted and are deemed disapproved if not reviewed in 30 days. Variances are allowed only in narrow hardship or design innovation cases.
- Assessments & fees: Annual assessments are levied uniformly on all improved lots (vacant lots pay 50%). The Board can increase annual assessments up to 10% without a vote; increases above 10% require 67% member approval. Special assessments also need 67% vote. A $250 Initial Contribution is due upon each sale of a completed home (adjustable up to 10% per year by Board). Late payments incur interest at the greater of 12% or legal max, plus late fees and collection costs.
- Lien & foreclosure: The Association has a continuing lien on each lot for unpaid assessments, interest, and fees. The lien can be enforced by judicial or nonjudicial foreclosure (with a court order). The lien is subordinate to a first mortgage. Foreclosure of a first mortgage extinguishes the assessment lien only for pre-foreclosure periods.
