What Winchester Lot's governing documents say
This document is a set of deed restrictions (covenants running with the land) for a single-family residential subdivision called Winchester Addition, Section 5, in Cleburne, Texas. It applies to all lot owners in that section and governs how each lot may be used and developed.
- Residential use & construction: Lots are for residential single-family dwellings only, no business or commercial activity. Exterior must be at least 70% brick, rock, or masonry; roofs must be composition at minimum 300 lb per square; garages must match the house; no portable metal buildings. Minimum living area is 1,500 sq ft on most lots, and 1,700 sq ft on specified lots.
- Parking & vehicles: No trailers, campers, or boats may be parked in front or side of a lot visible from the street for more than 30 days.
- Architectural review: No building may be erected or altered without approval of plans and specifications by the Architectural Control Committee. The committee has 30 days to act after submission; if no suit to enjoin is filed before completion, approval is deemed given.
- Animals: Only household pets are allowed; no nuisance or obnoxious activities may be carried on.
- Term & enforcement: Restrictions last 35 years from September 27, 1999, and automatically renew for successive 10-year periods unless a majority of lot owners file a modification or release. Any lot owner may enforce these restrictions by legal action.
- What this document doesn't cover: This document does not address membership in a homeowners' association, monthly assessments or fees, leasing restrictions, or maintenance obligations beyond the individual lot. It is solely a set of land-use restrictions.
