This document is the Bylaws and a Fifth Amendment for the POA of the Sanctuary at Lake Ridge, a homeowners association governing a subdivision in Cedar Hill, TX. The POA manages common areas and enforces deed restrictions; all property owners are members.
- Membership & voting: Each tract owner gets one membership. Voting members must be current on assessments and not in default. Proxies are allowed but only to voting or advisory members.
- Board of Directors: A three-person board manages the association. Directors serve until successors are elected. Before the Control Transfer Date, the developer (Bluegreen) can remove directors; after, a majority of voting members can remove them.
- Annual assessments: The annual assessment for The Fountains of Lake Ridge (a sub-area) can be increased up to 10% per year for no more than three consecutive years without a member vote. After that, any increase must be approved by the members as stated in the Declaration and Bylaws.
- Special assessments: The board may levy special assessments for unbudgeted or excess expenses, with documentation provided to members. They are levied against all lots and enforced like maintenance charges.
