Summer Crest Addition is a single-family home subdivision in Burleson, TX. These covenants, recorded by the developer between 1960 and 1971, apply to various lots and establish basic residential standards. They are binding on homeowners and run with the land.
- Land use & building type: Lots are for residential use only. Only one detached single-family dwelling (up to two stories in some sections) and a private garage for up to two cars are allowed.
- Lot & building size: Minimum lot area is 6,600 sq ft, with minimum width of 55 ft (60 ft for some lots). Minimum ground floor area of the main structure is 900 sq ft (or 1,000 sq ft for some lots), excluding open porches and garage. For two-story dwellings, minimum ground floor area is 700 sq ft (or 890 sq ft for some lots). Minimum dwelling cost at recording was $8,000 or $10,000 depending on the section.
- Setbacks & location: Front setback minimum 25 ft, side setback minimum 5 ft, and minimum 10 ft between dwellings. Garages located 50 ft or more from the setback line do not require a side yard. Eaves, steps, and open porches are not counted in setback measurements.
- Architectural review: No building, fence, or wall may be erected without approval of the Architectural Control Committee, considering workmanship, materials, design harmony, and location. The committee must act within 30 days; if it doesn't, approval is deemed given (unless a lawsuit is filed before completion).
- Prohibited uses & structures: No temporary structures, trailers, tents, or outbuildings may be used as residences. No oil drilling, mining, or refining operations. No obnoxious or offensive activities that become a nuisance.
- Garbage & sanitation: Trash and garbage must be kept in sanitary containers; incinerators must be clean. Lots cannot be used as dumping grounds. All city, county, and state sanitary codes apply.
- Duration & amendment: Covenants run for 25 years from recording, then auto-renew for successive 10-year periods unless a majority of lot owners vote to change them.
