- Construction defect resolution: Claims related to construction defects are subject to the Texas Residential Construction Liability Act (RCLA) and Texas Residential Construction Commission Act (TRCCA). A request for warranty performance is not considered a defect notice under these statutes; separate notice is required.
- Binding arbitration: All disputes must first be mediated, and if not resolved, submitted to binding arbitration. Arbitration is conducted by a single neutral arbitrator, and the owner is not initially required to pay more than court filing fees. The arbitrator can award costs and fees to the prevailing party.
- Warranty and acceptance: By signing, the owner acknowledges the improvements are complete (or discrepancies accepted) and releases the builder from all claims except those under the express limited warranty. The agreement runs with the land.
- Mold maintenance: The document includes maintenance recommendations to prevent mold, such as regular vacuuming, controlling humidity, venting kitchens and bathrooms, promptly drying leaks, and using bleach solutions. These are guidelines, not legally binding rules.
