What Tres Vistas Estates HOA's governing documents say
Tres Vistas Estates is a single-family home HOA in Cresson, TX. This document is a Deed Restriction Enforcement and Fine Policy adopted by the Board, along with a Management Certificate providing contact info. It explains how the HOA handles violations and fines, but does not list all community rules.
- Enforcement process: Violations start with a courtesy letter (optional), then a demand letter via certified mail. The owner has 30 days from receiving the demand letter to request a hearing. If no hearing is requested, the violation must be cured within the time frame stated in the demand letter, and fines may begin after the 30-day period. For subsequent similar violations within 6 months, the Board may skip the demand letter.
- Hearing rights: Upon written request, a hearing must be held within 30 days. Notice of hearing must be sent at least 10 days before. Either party can request a postponement of up to 10 days; further postponements require agreement. There is an option to appeal a committee decision to the Board.
- Fine schedule: For violations not affecting use/enjoyment: $50 first violation, $100 second, $150 subsequent. For violations affecting use/enjoyment (e.g., quiet enjoyment) or non-curable violations, the Board sets the fine as it reasonably relates. Each day may be a new violation. Intentional destruction of community property (grass, foliage) is a $500 fine.
- Interest and fees: Unpaid fines accrue interest at 10% per month compounded monthly. The owner is also liable for attorney's fees and costs incurred after the hearing (or after the 30-day period if no hearing requested).
- Owner responsibility: The owner is responsible for the actions of all residents, guests, and invitees. Fines for those parties are assessed against the owner's lot.
- Additional remedies: The Association may suspend access to common areas, file a lawsuit, and record a Certificate of Non-Compliance. A court may assess civil penalties of up to $200 per day per violation (per Texas Property Code §202.004(c)).
- Management and contact information: The Association's mailing address is PO Box 10, Cresson, TX 76035. Contact the President at 843-230-7274 or [email protected]. The Association charges resale certificate fees not exceeding the limits set by Texas Property Code §207.003.
- What this document doesn't cover: This is a fine policy only. It does not include the full set of covenants, such as architectural guidelines, pet rules, parking restrictions, or use restrictions. Those are contained in the Declaration, which is referenced but not provided here.
