Burleson West Bend South is a standard single-family homeowners' association in Burleson, TX. The rules bind all homeowners (lot owners). - Violation enforcement process: The association sends a courtesy notice (14-day cure period, or 3 days for certain violations), then a Notice of Violation (with a specific cure date, a hearing request deadline of 30 days after mailing, and a proposed fine). If not cured, a fine is imposed. The association may also take corrective action (self-help) after further notice, or refer to legal counsel.
- Fine structure: Initial fines are at least $50 and may not exceed $500 per violation. For curable violations: first fine $50, second $100, third $200, subsequent $400. For uncurable or health/safety violations: first fine up to $2,000. For unapproved ACC modifications: first $100, second $200, third $400, fourth and subsequent $500. Fines may be imposed daily until cured, with no aggregate limit. Repeated violations within 6 months can double the fine.
- Right to a hearing: An owner may request a hearing in writing within 30 days after the Notice of Violation is mailed. The board must hold a hearing within 30 days of receiving the request. The association must provide an evidence packet 10 days before the hearing. The owner may present their case and make an audio recording. The board must notify the owner of the decision within 10 days after the hearing.
- Security measures: Owners may install security cameras, motion detectors, and similar devices on their own property, subject to architectural review. Perimeter fences must be black wrought iron or equivalent, not exceeding 4 feet in height if enclosing the front of the lot. The association may modify restrictions to allow economical installation of security measures while preserving the original intent.
- Religious item displays: Owners or residents may display one or more religious items on their lot or dwelling, provided the display is motivated by sincere religious belief, does not threaten health/safety, is not patently offensive for non-religious reasons, and complies with setbacks, easements, and other laws. Items may not be placed on common area or on traffic/utility fixtures. Owners are encouraged (not required) to seek architectural review committee confirmation.
- Swimming pool enclosures: Owners may install a pool enclosure (transparent mesh or clear panels in metal frames, max 6 feet tall, not climbable) without prior approval if it is black in color. Alternative colors or materials require architectural review committee approval. The enclosure must comply with state and local safety requirements; association approval does not guarantee compliance.
- Payment plan policy: The association offers payment plans for delinquent assessments and fees lasting from 3 to 12 months. A fee is charged to establish and administer the plan. Interest is suspended during the plan. Default occurs if a payment is missed, not paid in full, or if new assessments are not paid. Default may result in immediate acceleration of the balance and collection measures. Owners are ineligible for a new plan for one year after defaulting on a prior plan.
