What Burleson Oaks Est's governing documents say
Burleson Oaks Estates (Cross Timber, TX) is a single-family residential subdivision of 44 lots governed by restrictions recorded in 1966. A later property owner's association charter (1993) provides a mechanism for residents to enforce the restrictions and maintain the neighborhood, but the association has no dues or formal officers.
- Land use: All lots are for residential use only, except the tract labeled 1-A (west of Baptist Church). No noxious, offensive, or unlawful activities; no hog farms or wrecking yards.
- Building & dwelling requirements: Only one single-family residence (max 2 stories) plus subordinate outbuildings (garages, barns, servants' quarters) allowed. No house trailers, tents, temporary structures, or moved buildings. Minimum inside ground floor area: 1,000 sq ft (excluding open porches, breezeways, bay windows, garages). Exterior must be at least 25% brick or stone veneer. Each dwelling must have a septic system approved by the state health department and running water before occupancy. No outside toilets.
- Setbacks: Buildings must comply with front and side street setback lines shown on the recorded plat (Exhibit B). The developer or subsequent owners may alter setback lines for unsold lots or with consent of affected lot owners. Setbacks do not apply to boundary fences or plantings.
- Animals: Livestock, poultry, and pets are permitted, but hog farms and wrecking yards are prohibited.
- Easements: No permanent improvements may be placed on areas reserved for easements as shown on the plat.
- Developer rights: The developer (E. J. Maxwell and successors) retains the right to replat unsold lots, change minimum square footage, and adjust streets/easements before public use, provided no lot is reduced below 43,560 sq ft and no owner is deprived of reasonable access. The developer may also add additional restrictions in individual deeds.
- Duration, amendment & enforcement: Restrictions run until January 1, 1990, then auto-renew for successive 10-year periods. During the renewal year, owners of more than 50% of the front footage may release any restriction. Any owner may sue to enforce the covenants; failure to enforce once does not waive future enforcement. The restrictions are covenants running with the land binding all owners.
- Property owner's association: A voluntary association (established 1993) with no dues and no formal officers. Any member may call a meeting; majority of those present decides actions. Membership is by signing the roster. The association's purpose is to enforce the restrictions and cooperate to preserve neighborhood character and safety. Charter may be revised by membership vote.
