What North Crest's governing documents say
North Crest Lot is a standard single-family home subdivision in Keene, TX, governed by restrictive covenants recorded in 1970 and amended in 1973. These rules bind all lot owners and are designed to maintain a residential character.
- Lot use: All lots except Lot 36, Block 2 and Lot 37, Block 3 must be used for residential purposes only; no business or commercial activity is allowed on those lots.
- Structure requirements: Structures must be single or two-family dwellings, no more than two stories, with a minimum of 1,400 square feet of ground floor area (excluding open porches and garages). The residence must be at least 70% brick, rock, or masonry construction; private garages, servants' quarters, and outbuildings need only be of good construction.
- Setbacks & subdivision: Buildings must comply with set-back lines shown on the recorded plat, and no structure may be located closer than 15 feet to an interior lot line. Lots cannot be subdivided without unanimous written approval of the Architectural Control Committee and all abutting lot owners.
- Animals: Only household pets, horses, or cattle may be kept, and no animals may be raised for commercial purposes. If horses or cattle are kept, the pasture fence must be at least 75 feet from adjoining homes. No obnoxious or offensive activities are allowed.
- Architectural control: An Architectural Control Committee (originally named) oversees design and construction. All building plans and site plans must be approved as to workmanship, harmony of external design, and location. Approval is deemed given if the committee fails to act within 30 days or if no suit to enjoin is filed before completion.
- Term & amendments: Covenants run for 25 years from April 10, 1970, and automatically renew for successive 5-year periods unless a majority of lot owners record an instrument modifying or terminating them. Individual lot amendments to set-back, size, or materials require unanimous approval of the committee and abutting owners.
