4418 Bowser Condominium is a 5-unit condominium building in Dallas, TX — you own your individual apartment unit and an undivided interest in common elements (land, building structure, parking spaces). The association maintains common areas and carries master insurance. This document is the original 1980 Declaration and Master Deed, which sets the basic rules for ownership, use, and governance.
- What you own & maintain: You own the interior of your apartment (walls, floors, fixtures, appliances, heating/cooling equipment) and an undivided percentage interest in the general common elements (land, foundations, roof, halls, parking spaces, etc.). You do not own the structural perimeter walls, pipes, wires, or other elements serving multiple units. The association maintains all common elements.
- Leasing & rentals: Leases must be for at least 30 days; rentals for shorter periods or with hotel services (maid, food, bellboy) are prohibited. Units may be rented furnished or unfurnished, but the lease must comply with the Declaration and By-laws. Each unit must be used as a single-family dwelling.
- Residential use only: Units may be occupied and used only as private dwellings. No professional, business, or commercial use is allowed.
- Parking: There are 9 parking spaces, which are part of the general common elements but designated as limited common elements for specific units: Units 101, 102, 103, 104 each get two spaces; Unit 105 gets one space. The Board may assign any unassigned spaces.
- Assessments & fees: Each owner must pay a monthly (or otherwise periodic) assessment based on their unit's percentage of undivided interest in the common elements. Assessments are due within 21 days unless the By-laws specify otherwise. Unpaid assessments become a lien on the unit, subordinate only to property taxes and prior recorded mortgages. The association may foreclose on the lien and recover reasonable attorney's fees.
- Voting & governance: The Council of Co-Owners (all unit owners) governs the project. Voting is by percentage interest (as shown in Exhibit I). A majority (51%) constitutes a quorum. The Board of Administration (3 members, all must be owners or employees of corporate owners) manages daily affairs. Decisions of the Council require a majority vote unless otherwise specified. Annual meetings are held each June.
- Insurance: The association must obtain blanket property insurance covering the buildings and owners against risks. Insurance costs are a common expense shared pro-rata according to each unit's percentage interest. Owners may also insure their own units separately.
- What this document doesn't cover: This Declaration does not address pet restrictions, age restrictions, architectural review, or limits on the number of rentals beyond the minimum 30-day term. It is the foundational document; later amendments or association rules may add further restrictions.
