Valencia Estates is a single-family home planned community in Little Elm, TX (Denton County). You own your lot and house; the homeowners association maintains common areas and enforces uniform standards through architectural review, landscaping rules, and use restrictions. Living here requires compliance with detailed design guidelines, parking limitations, and pet limits.
- What you own & maintain: You own your lot and house. You must maintain the exterior, landscaping, fences, and other improvements in good condition and in compliance with community standards. The association may maintain certain perimeter fences and landscaping but has no obligation to do so.
- Architectural review: All new construction, exterior alterations, fences, pools, and landscaping must be approved in writing by the Reviewer (Declarant initially, later the Architectural Control Committee). The Reviewer has sole discretion over aesthetics, including design, materials, and colors. Plans must be submitted; approval is deemed denied if not acted on within 30 business days. Variances may be granted in writing.
- Parking & vehicles: Vehicles must be parked in garage or driveway. Recreational vehicles, trailers, boats, commercial vehicles with logos, and unlicensed/inoperable vehicles are prohibited on streets and must be parked in an enclosed garage or rear driveway (if accessible by alley). Pickup trucks without commercial lettering and SUVs/minivans are treated as automobiles and may park outside. Boats must be concealed from street view. No flammable cargo vehicles allowed.
- Pets: No more than 3 household pets per lot (dogs, cats, etc.). Pets must be leashed or fenced when outside, registered/licensed, and waste must be cleaned up. Pets roaming free or deemed a nuisance may be removed upon board request.
- Leasing & rentals: The document does not impose a minimum lease term or restrict leasing beyond single-family use. No specific lease restrictions are noted; however, all occupants must comply with occupancy limits (see below).
- Occupancy and use: Each lot may have only one detached single-family residence (max 2.5 stories). Occupancy is limited to persons living together as a single housekeeping unit; for unrelated persons, no more than 2 per bedroom. Home offices and quiet, inoffensive activities are allowed if consistent with residential character. Commercial and manufacturing uses are prohibited.
- Minimum floor area: Minimum air-conditioned living area varies by lot type: Lot Type 1: 12,000 sq ft; Type 2: 10,000 sq ft; Type 3: 7,200 sq ft; Type 4: 4,000 sq ft; Type 5: 2,500 sq ft. This applies to new construction.
- Fines and enforcement: Fines up to $500 per violation, per occurrence, with a graduated schedule: $50 first fine, $75 second, $100 third, then $100 bi-weekly until cured or max reached. At least one notice before fines/self-help. The board may also suspend voting rights and use of common facilities, and require removal of noncompliant trees or landscaping.
