Britty Condominiums is a 16-unit condominium in Dallas, TX — you own your individual unit plus a shared interest in the common elements (including land, building structure, and amenities). The association manages common areas and collects assessments for maintenance, insurance, and operations. This document is the full declaration of condominium, binding all unit owners.
- What you own & maintain: You own the interior of your unit (including fixtures and finishes) but not unfinished surfaces, load-bearing walls, or utility lines serving multiple units. You must maintain your unit's interior, patio/balcony, and heating/cooling system. The association maintains common elements and carries master insurance (property and liability) on the building.
- Leasing & rentals: Leases must be for at least 30 days (no transient/hotel use), must be in writing, and must require the tenant to comply with all association rules. You cannot lease less than an entire unit. You remain responsible for all obligations even when renting.
- Pets: No animals other than household pets (dogs, cats, fish, birds) are allowed. The limit is generally two pets per household, but the association may adjust that number or restrict size/weight. Animals must be leashed or enclosed when outside, and owners are liable for noise or damage.
- Parking & vehicles: Park only in designated spaces. No inoperable vehicles, large commercial trucks, recreational vehicles, or boats may be stored on the property. Major vehicle repairs are prohibited. Motorcycles and similar vehicles may only be driven to and from parking spaces.
- Use & occupancy restrictions: Units must be used as one-family residential dwellings only (owner, family, guests, or tenants). No signs visible from outside without board approval. No nuisances (loud noises, odors). No storage in common areas except designated areas. No temporary structures, and no exterior fires except contained barbecues.
- Assessments & fees: Monthly assessments are due on the 1st, with a $5 late fee after the 15th. Assessments cover common expenses (maintenance, insurance, utilities, management, reserves). Special assessments require a 2/3 vote of owners. The association may suspend voting rights and facility use for nonpayment.
- Alterations & improvements: No structural alterations or changes to common elements without prior written board approval. Submit plans; the board must respond within 30 days. During declarant control, declarant has sole approval authority.
- Declarant rights (developer): The declarant (Hester Development) retains control of the association until January 1, 1989, or until 75% of units are sold, or until the project becomes self-supporting (whichever comes first). Declarant may maintain sales office, signs, and modify unsold unit plans.
