What Cole House Owners's governing documents say
Cole House is a 19-unit condominium community in Dallas, TX. The documents excerpted here are supplemental policies and amendments to the declaration and bylaws, covering fines, enforcement, pet rules, parking, common area use, late assessments, and utility shut-offs.
- Fines & enforcement: The association may levy fines for rule violations. First violations are curable with a $250 fine avoidable if cured. Repeat violations incur $250, then $500, then $1,000 fines. Continuous violations may be fined daily/monthly/quarterly at board discretion. Move-in/out violations require a board hearing; fine amount TBD. Fines must be reasonable. The association cannot foreclose on fines alone.
- Pets: Pets must be leashed and controlled. Pet waste must be picked up immediately. Feeding animals in common areas is prohibited. A $25 fine is assessed per violation. Only one designated pet area (grassy area along main driveway) is allowed.
- Parking & vehicles: Parking spaces are assigned. You must park in your assigned space unless you have permission. You are responsible for any damage or waste (e.g., oil drips). Towing is enforced at owner's expense. Access gate remotes are your responsibility.
- Common area use: Pool, laundry room, and trash enclosure must be kept closed and locked. Swimwear required in pool area; no diving. Children under 12 must be accompanied by an adult. Trash left in common areas results in a $25 fine. Keep doors and windows closed while operating HVAC.
- Assessment late fees & delinquencies: Monthly assessments are due by the 10th. Late charges: $25 for first two occurrences in 12 months, $100 for each thereafter. Interest at 10% per annum. Special assessments are due in 15 days; same late charges apply. The association may terminate utilities for nonpayment with a 30-day notice (per a 1990 resolution).
- Utility shut-off for delinquent assessments: If an account is 60 days delinquent, the association sends a 15-day cure notice. If not cured, a 7-day shut-off notice is sent by certified mail and posted on the door. A $50 minimum shut-off fee applies. Payment must be by cashier's check for all amounts owed. Shut-off will not occur on days when personnel are unavailable or if life-threatening. Owners may request a hearing but must deposit the full amount claimed.
- Move-in/move-out rules: Owners must provide at least 10 days' written notice of move-in/out, including request for elevator/loading dock usage. Failure to do so results in a mandatory board hearing where a fine may be assessed.
