What Howell Pk Homeowners's governing documents say
Howell Park is a standard single-family home HOA in Dallas, TX. This document is the Association's Bylaws only—the full rules and restrictions are in a separate Declaration of Covenants, Conditions and Restrictions not included here. The Bylaws govern how the HOA is run (meetings, board, elections, assessments) but do not contain use restrictions (pets, rentals, parking, etc.).
- Meetings of members: Annual meetings require 15 days' notice posted within the property. Special meetings may be called by the President, Board, or 1/4 of votes. Quorum is 1/10 of votes; if not met, a subsequent meeting's quorum is half that (1/20). Members may vote by proxy.
- Board of Directors: The Board has 3 directors (expandable to 5 by Declarant while it has majority vote). Directors need not be members or residents. After the Election Date, members elect directors for staggered 2-year terms. Directors may be removed with or without cause by 2/3 of votes.
- Assessments & liens: Each dwelling unit is subject to annual, special, and enforcement assessments secured by a lien on the property. Delinquent assessments bear interest at the highest legal rate, and the Association may sue or foreclose, adding collection costs and attorney fees. Owners cannot avoid assessments by non-use or abandonment.
- Appeals process: Decisions of the Modification Committee or other committees may be appealed to the Board after exhausting lower avenues. Appeals must be in writing, followed by a hearing on at least 7 days' notice. The Board may uphold, amend, or overturn by majority vote. Members must exhaust all remedies before going to court (except for non-payment of assessments).
- Amendments & governing documents hierarchy: Bylaws may be amended by a majority of a quorum at a members' meeting, with proper notice. In case of conflict, the Articles of Incorporation take precedence over the Bylaws, and the Declaration takes precedence over both.
- What this document doesn't cover: This document is only the Bylaws. It does not include the actual deed restrictions (Declaration) that govern use of property—such as pet limits, lease terms, parking, architectural standards, or age restrictions.
