What Mccreary Estates Homeowners Association, Inc.'s governing documents say
This document is a Covenant Enforcement and Fine Policy for McCreary Estates Homeowners Association, Inc., a standard single-family HOA in Dallas, TX. It sets out the procedures and fines for violations of the community's governing documents. This policy applies to all homeowners and their tenants.
- Violation notice process: The Association sends a First Courtesy Notice (21-30 days to cure), then a Second Courtesy Notice, then a Notice of Violation (14 days to cure). Incurable violations (e.g., threats to health or safety, firearms, noise, damaging property) receive an immediate Notice of Violation with no cure period.
- Fine schedule: For curable violations, fines escalate from $50 (first) to $500 (fifth and subsequent). Fines may be imposed every 10 days while the violation continues, with no aggregate limit. Incurable violations carry a flat $500 fine.
- Right to a hearing: An owner may request a hearing before the Board within 30 days of receiving a Notice of Violation. The hearing must be held within 30 days of the request. The owner may present evidence and be represented.
- Corrective action by Association: The Association may correct a violation (self-help) after giving 7 days' written notice. Costs are levied as a special assessment against the owner.
- Cure during enforcement: An owner may cure a violation at any time. If cured after a Courtesy Notice, a second violation of the same rule triggers a Notice of Violation directly. Fines are special assessments secured by a lien on the property.
- What this document doesn't cover: This is only the fine policy. It does not contain the community's full rules (e.g., architectural standards, pet limits, parking rules, age restrictions). Those are in the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) and other governing documents.
