This document is the Bylaws of the North Preston Lakes Estates Homeowners Association, a single-family residential HOA in Celina, Texas. It explains how the association is governed—board elections, meetings, budgets, assessments, and enforcement—and applies to all lot owners. Actual use restrictions like pet limits or architectural rules are in the separate Declaration, not this document.
- Association structure & governance: The HOA is run by a board of 3 to 5 directors. The developer (Class B member) appoints all directors initially, but homeowners gradually elect directors once they own 50% and then 75% of lots. Member meetings require a quorum of 20% of Class A votes.
- Assessments & dues: The board sets annual assessments to cover common expenses, payable in one annual installment due January 1, and considered late after 30 days unless the board decides otherwise.
- Enforcement & violations: The board can impose fines, suspend voting rights, or limit use of common areas for rule violations, but must give written notice and a 30-day window to request a hearing. Repeat offenders within six months may not get another cure period.
- Amendments: The developer can amend the Bylaws unilaterally to comply with law, satisfy lenders, or if it still owns property and the change doesn't materially harm owners. Otherwise, owners with at least 51% of Class A votes plus developer consent are required.
- Declarant (developer) control: While the developer owns property for sale, it retains the right to disapprove certain board actions and to appoint a majority of directors until specific ownership thresholds are met.
