This is a supplement (amendment) to the By-Laws of Turtle Creek North Condominium Association, a condominium community in Highland Park, TX. The supplement adds specific rights for institutional first mortgage holders and clarifies procedures for damage, condemnation, defaults, and liens. It does not replace the full By-Laws or Declaration, and many standard community rules (pets, leasing, parking) are not addressed here.
- Mortgagee rights: Institutional holders of first mortgages on units are entitled to timely written notice of substantial damage or destruction to any unit or common element, and of any condemnation or eminent domain proceedings affecting the property.
- Condemnation & insurance: The Association has sole authority to decide whether to rebuild or restore common elements after condemnation; all awards are deposited with the Association for the benefit of unit owners and their mortgagees as their interests appear.
- Default notices to mortgagees: Upon request from a mortgage company holding a first mortgage, the Association must report any default in a unit owner's obligations that has not been cured within 30 days.
- Lien extinguishment after foreclosure: If a lien for common expenses is extinguished due to foreclosure or deed in lieu of foreclosure of a first mortgage, that amount is borne pro rata by all remaining unit owners (including the foreclosing mortgage holder) according to their common element ownership percentages.
- What this document doesn't cover: This supplement does not address typical HOA topics such as pet restrictions, leasing requirements (e.g., minimum lease terms), parking rules, architectural standards, or age restrictions. Those rules would be in the full By-Laws and Declaration of Condominium.
