- Architectural review: The HOA's Architectural Review Committee (ARC) must approve exterior changes. In Phase 1, contemporary and modern designs (including contemporary roof lines) are considered on an individual basis. In Phases 3A/3B, front yard setbacks are a minimum of 20 feet, balconies are allowed only if they face the rear and are set back 50 feet from the rear property line (covered, with doors), and cluster mailboxes replace individual mailbox designs.
- Assessments & collections: If you fall behind on HOA assessments, the association follows a collection process: a friendly notice (after the 30th day, with a $25 monthly late fee plus $8 processing fee), a formal notice (30 days later, $18 fee), a demand letter (second 30-day notice, $35 fee), then lien and possible foreclosure. Fees and timelines may vary based on the governing documents.
- Alternative payment plans: If you are delinquent, you can request an alternative payment schedule. The minimum term is 3 months, the maximum is 18 months. During the plan, no additional penalties are charged (only reasonable admin costs and interest). Owners who defaulted on a previous plan within the last two years are generally not eligible unless the Board allows it.
- Payment priority: When you make a payment, the HOA applies it in a specific order: first to delinquent assessments, then current assessments, then attorney/collection fees related to assessments, then other attorney fees, then fines, then other amounts owed. If you are in default on an alternative payment plan, the order changes to prioritize attorney/collection fees first.
- Records requests: Homeowners can request HOA records, but must pay copying and labor costs. Standard paper copies are $0.10 per page; labor for locating and reproducing records is $15 per hour (waived for requests of 50 pages or less unless records are in multiple buildings or remote storage). Programming labor is $28.50 per hour, and an overhead charge of 20% of labor costs may apply.
