What Turtle Creek North Condominium Association's governing documents say
Turtle Creek North is a condominium community in Dallas, TX — you own your unit and share the building's common elements. The association manages the property, maintains common areas, and collects assessments from unit owners. These amended and restated bylaws govern how the association operates, including elections, meetings, budgets, and enforcement of rules and fees.
- Board of Directors: The Board has 5 directors, each serving staggered 3-year terms, with a maximum of two consecutive terms. Directors must be owners or their spouses and reside in the unit. No one with a felony conviction or over 90 days delinquent on assessments may serve.
- Meetings & Voting: Annual member meetings are required; special meetings can be called by the President, a majority of the Board, or by petition of owners holding 20% of votes. Quorum for member meetings is 50% of total votes. Board meetings require at least 4 per year, with a quorum of 4 directors.
- Assessments & fees: Regular assessments are based on each unit's ownership interest in common elements and are typically due monthly. Special assessments up to 1/20 of the annual budget can be levied by the Board without a vote; larger amounts require majority approval. Delinquent assessments accrue interest at 18% per annum (or the maximum lawful rate) plus late charges, collection costs, and attorney fees.
- Lien & Enforcement: The association has a lien on each unit for unpaid assessments, fines, and other charges, which is subordinate only to property taxes, first mortgages, and certain other liens. The association may foreclose on the lien (excluding fines-only liens) through judicial or non-judicial sale.
- What this document doesn't cover: This document is the association's bylaws (governing internal operations) and does not include specific use restrictions, pet rules, leasing limits, or architectural guidelines. Those may be found in the Declaration of Condominium or separate rules.
