Fannin Farm is a single-family home subdivision in Arlington, TX, governed by a homeowners' association (Fannin Farm Association, Inc.). These supplementary declarations add specific phases (Area II and Area X) to the overall scheme, imposing uniform covenants on all lots. As a homeowner or buyer here, you must comply with architectural controls, maintain your property, and pay annual assessments.
- Architectural review: All exterior improvements (buildings, fences, walls, driveways, etc.) require prior written approval from the Architectural Control Committee. Plans must be submitted; if the committee does not act within 15 days, the plans are deemed approved. The committee can reject based on design harmony and site compatibility.
- Assessments: Each lot owner must pay an annual assessment: $100 per year for Area II (may be increased by membership vote) and $125 per year for Area X. Special assessments may also be levied for capital improvements. Unpaid assessments become a lien on the property and accrue 10% annual interest.
- Building standards: Each lot may contain only one detached single-family dwelling (max 2 stories or 35 feet) and a private garage for up to 3 cars. Minimum floor area is 1,500 square feet (excluding garages, porches, etc.). Front setback is 20 feet; side and rear setbacks follow city code. Exterior walls below the first-floor ceiling must be at least 80% masonry.
- Use restrictions: Lots are for residential use only. No commercial activities, no manufactured homes, no temporary structures. No more than two domestic pets (dogs, cats) are allowed, and they cannot be bred or kept for commercial purposes. No burning of trash except for cooking charcoal. No exterior loudspeakers or amplifiers without approval.
- Parking & vehicles: No commercial vehicles (with business signs) may habitually park in front of the lot. Trucks, boats, campers, and trailers must be stored in the garage or backyard. No buses or mobile homes may be parked on the lot. No major vehicle repairs visible from the street.
- Signs: For-sale signs are limited to 6 square feet. During construction, builder signs up to 12 square feet are allowed. All signs must comply with city ordinance and cannot be displayed without approval.
- Maintenance obligations: Owners must maintain their lot, including the parkway between the lot and street, all structures, and landscaping. Weeds and grass must be kept cut. If the owner fails to maintain, the association or declarant may enter and charge the owner, which becomes a lien.
- Fences & landscaping: Fences, walls, and hedges require committee approval and cannot exceed 6 feet in height. They must be set back from front and side property lines per setback requirements. Trees, shrubs, and plantings must not overhang sidewalks or streets below 7 feet.
