What Deer Valley Homeowners''s governing documents say
This is a Property Owners' Association Management Certificate Amendment for the Deer Valley Homeowners' Association, a single-family home HOA in Fort Worth, Texas. It records administrative details and adopts several policies required by the Texas Property Code. - Records retention & inspection: The Association must permanently retain formation documents and covenants, financial books for 7 years, owner account records for 5 years, contracts for 4 years after expiration, and meeting minutes for 7 years. Owners may request to inspect or purchase copies of records by certified mail, and must pay estimated production costs in advance.
- Payment plans for delinquent assessments: An owner who has not defaulted on a prior payment plan in the last 2 years may request a plan. Minimum term is 3 months, maximum term is 18 months, and the Association may require a good-faith payment of up to 25% before starting. Certain roofing materials require approval. Rainwater collection devices must match home color and may be regulated if visible. Solar panels require approval and generally must be on rear-facing roof or below fence line. Flagpoles and flags (American, Texas, military) require approval for height and location; must be maintained and noise abated. Drought-resistant landscaping (xeriscaping) requires a variance and must be maintained; borders, ground cover, and plant restrictions apply.
- Violation enforcement & fines: Violations are addressed with a courtesy notice, then notices giving 10-30 days to correct, and eventually attorney involvement. The Board may escalate based on severity or history. Owners may request extensions. Attorneys' fees may be charged to the owner and a lien may be filed.
- Assessment collection & fees: Delinquent assessments trigger a series of notices and escalating fees, including late charges, title search fees ($50), skip trace fees ($95+), courier fees ($60), and attorney/collection costs. Payments are applied first to delinquent assessments, then current assessments, then attorney's fees, fines, and other amounts.
- Conflict of interest for board contracts: Contracts with a board member or their relative/company are allowed only if two other competitive bids are obtained (if available), the conflicted director does not participate in discussion or voting, and the Board certifies compliance. Such contracts are void if violated.
