What Eden Road Estates's governing documents say
This is a set of Covenants, Conditions, and Restrictions (CC&Rs) for single-family residential lots in Eden Road Estates (Sections 2, 3, 4, and 5) in Arlington/Kennedale, Texas. These rules run with the land and bind all current and future owners. The document does not establish a homeowners' association, so there are no mandatory dues or an active architectural review committee after 2004.
- What you can build: Only one private dwelling house per lot, occupied by one family, plus a garage, servant house, and necessary outbuildings. Minimum gross living area is specified (OCR unclear), but it excludes breezeways, garages, porches, carports. Exterior walls must be at least 65% brick, stone, or other masonry to the top plate of the first story.
- Setbacks & fences: A building setback line is established by the recorded plat; no fence may extend nearer to the street than the front line of the improvement. Maximum fence height is 8 feet or city requirement, whichever is less.
- Use restrictions: No noxious or offensive trade or activity, no oil drilling, mining, or quarrying. No trailers, basements, tents, shacks, barns, or garages may be used as residences (temporary or permanent). Sales/construction trailers allowed only during construction/marketing.
- Pets & animals: Domestic animals are limited to the number used for companionship of the private family. Commercial keeping is prohibited. Specifically excluded: horses, cows, sheep, goats, guinea fowls, ducks, chickens, turkeys, or other animals that interfere with community quietude, health, or safety.
- Garbage & waste: No lot may be used as a dumping ground. Trash, garbage, or other waste must be kept in containers; incinerators and disposal equipment must be kept clean and sanitary.
- Architectural review (outdated): Until January 1, 2004, building plans required written approval from the Developer. After that date, approval is not required unless a majority of lot owners appoint a new representative and record that appointment. The Developer's powers have ceased.
- Duration & amendment: These restrictions are effective for 30 years from the recording date and automatically renew for successive 10-year periods, unless a majority of then-owners agree in writing to change or terminate them.
- What this document doesn't cover: No HOA fees, no rental restrictions, no age restrictions, no parking rules, no maintenance obligations beyond the restrictions listed. The text is garbled in parts; some specifics (like exact minimum square footage) are unclear.
