This is a Common Wall Agreement and set of covenants for a specific pair of attached lots in the Twenty Oaks community in Dalworthington Gardens (Arlington), TX. It is an ancillary document that only applies to the owners of Lot 33 and Lot 34, Block 1, Section One. It governs the shared party wall, party fence, water lines, sidewalks, and related maintenance and easements between those two lots, not the entire community.
- Party wall & fence maintenance: Each owner must maintain the exterior walls and roofs of their own property. The costs to repair or maintain the party wall, fence, and shared utilities (water lines, sidewalks) due to normal wear or physical damage are shared equally between the two adjoining owners.
- Cost sharing & repairs: If damage is caused by negligence of one owner, that owner bears the full cost of repair. If an owner fails to pay their share, the other owner may have the work done and file a mechanic's lien on the defaulting owner's lot and dwelling, plus recover attorney's fees.
- Easements: Each owner grants the other a perpetual easement over the part of their lot where the party wall, fence, water lines, sidewalks, and sprinkler lines are located, for construction, maintenance, repair, and service. Each owner also has a right of egress and access across the adjacent property for performing work related to these shared elements.
- Alteration restrictions: Neither owner may alter or change the party wall, fence, water lines, sidewalks, or sprinkler lines in any manner (except non-structural interior decoration). These must remain in the same location as when built by the builder. No act may tend to depreciate the value of the building, including variations in design, color, or roofing.
- Insurance & liability: If an owner’s negligence, disinterest, or willful act exposes the party wall or roof to the elements, that owner bears the full cost of weatherproofing and any resulting damages. The document does not specify master insurance; each owner appears responsible for their own property.
