What East Oaks 1's governing documents say
East Oaks, Phase I, is a single-family residential subdivision in Denton, TX, governed by a Declaration of Restrictions filed in 1991. These covenants apply to all lot owners and restrict land use, building size and materials, fences, signs, vehicles, and other nuisances. An Architectural Control Committee originally oversaw approvals, but its powers expired on December 31, 2015, unless renewed by a majority of lot owners.
- Land use & building type: Only single-family detached residential dwellings, not exceeding two stories, are permitted. A detached garage is allowed with committee approval.
- Dwelling size & construction: Minimum living area of 1,350 square feet (excluding porches, terraces, driveways, garages). At least 75% of first-story exterior wall area (excluding windows/doors) must be clay fired brick, stone, or other approved masonry.
- Fences: No fences in front of the minimum building setback line. Fences parallel to front or side street lines must be wood or masonry. Fences along back or interior side property lines may be chain link or wire.
- Parking & vehicles: Trucks over 3/4 ton cannot park on streets, driveways, or lots overnight. Vehicles transporting flammable/explosive cargo are banned. Mobile homes, boats, travel trailers, and motor homes are allowed only if stored behind the front or side building line and enclosed by a 6-foot privacy fence.
- Signs: Only one professional sign (max 5 sq ft) advertising the property for rent or sale, or a builder's sign during construction/sale, is allowed.
- Prohibited uses: No noxious/offensive activities or nuisances. No obstruction of utility easements. No oil, gas, or mining operations. No individual water supply or septic systems; all structures must connect to public water and sewer.
- Sightline limitations: On corner lots, no fence, wall, hedge, or shrub between 2 and 6 feet height may obstruct sight lines within a 25-foot triangle from street intersections. Similar rules apply within 10 feet of driveway or alley pavement intersections.
- Architectural review: Plans must be approved by the Architectural Control Committee, which originally comprised Larry A. Schneider and Glenn W. Justice. Approval is deemed given if not acted on within 30 days. The committee's authority expired December 31, 2015, unless extended by a recorded instrument signed by a majority of lot owners.
