What Kings Garden's governing documents say
King's Garden is a standard single-family home HOA community in Frisco, TX. These Covenants, Conditions & Restrictions (CC&Rs) bind all homeowners and residents. The Association (King's Garden Owners Association) manages common areas and enforces rules, and the Architectural Control Committee (ACC) controls exterior changes.
- Architectural review: Prior written ACC approval is required for any exterior improvement, addition, or alteration visible from a street or another lot, including fences, sheds, basketball hoops, and landscaping. The ACC has 60 days to respond; if no response, the owner may proceed. Interior remodeling does not require approval.
- Leasing & rentals: Homeowners may lease their dwellings, but all leases must comply with the governing documents. The owner is responsible for tenant compliance and must provide the tenant with copies of the rules. The Association may enforce rules against the tenant, including eviction, and the owner is liable for any Association expenses incurred.
- Pets & animals: No commercial or food animals are allowed. Customary household pets are permitted, but no more than 4 dogs and/or cats per lot unless the Board adopts a different limit. Pets must be kept inside or in a fenced yard and must not disturb neighbors.
- Vehicles & parking: The Board may regulate vehicle types, sizes, conditions, and parking. Boats, trailers, and inoperable vehicles may not be stored on driveways. Garage doors must stay closed except when vehicles are entering or leaving. Parking on streets is subject to Board rules.
- Use restrictions: Lots are for residential use only; home businesses are allowed only if they are incidental and have no external evidence. Annoying activities, loud noises, noxious odors, exterior fires (except barbecue grills), and hunting/shooting are prohibited. Only one professionally made sign up to 5 square feet is allowed per lot for sale or rent.
- Maintenance responsibilities: The Association maintains common areas (including screening walls, entrances, and certain landscaping) and may maintain private streets if converted. Each owner is responsible for maintaining their lot and dwelling, including any easements crossing their lot. Owners must keep their property not unsightly.
- Fences & accessory structures: All fences and accessory structures (sheds, playhouses, etc.) require ACC prior written approval. Accessory structures are not allowed in front yards or unfenced side yards facing streets. Fencing must be approved for materials, height, style, and color.
