This is the Third Amendment to the Declaration of Covenants, Conditions and Restrictions for River Walk at Central Park in Double Oak, TX. The community is a single-family home or townhome subdivision governed by a homeowners association (HOA). This document only amends specific financial and administrative provisions of the full CC&Rs; it does not contain all community rules, such as those about pets, leasing, or architectural standards.
- Development Period: The Development Period (during which the developer has special rights) now ends on January 31, 2058, or earlier if the developer records a termination.
- Assessments & Reserve Fund: Any annual budget surplus can be allocated to the reserve fund or set aside as reserves for any other line item (including operating expenses). The reserve fund may also be used for operating or administrative expenses as the Board determines. The Board may levy Special Group Assessments by majority vote.
- Declarant Powers & Loans: During the Development Period, the declarant may unilaterally amend the Declaration (subject to certain consents). The declarant may, but is not obligated to, fund Association deficits; any such funding is treated as a loan at 6% annual interest, due on demand of the declarant after three years or end of the Development Period. Property owned by the declarant is exempt from assessments during the Development Period.
- What this document doesn't cover: This amendment does not address pet restrictions, leasing minimums, age or occupancy limits, architectural review, parking, or any other standard HOA rules. Those would be found in the original Declaration and other governing documents.
