What Brook Meadows Lakefront's governing documents say
This is the governing declaration for the Brook Meadows Lakefront Homeowners Association, a single-family HOA of 9 lakefront lots in the Brook Meadows Addition, Colleyville, TX. It creates mandatory membership, sets assessments for common area maintenance (including a private lake), and imposes property-use rules for owners of these lots.
- Mandatory membership & voting: Every owner of a lot in the association is automatically a member with one vote per lot. Voting rights and common-area use can be suspended for rule violations or nonpayment of assessments.
- Assessments & fees: Annual assessments are levied per lot; the maximum can increase each year by the Consumer Price Index without a vote. Any increase beyond that requires approval of 2/3 of owners. Special assessments for capital improvements (e.g., lake repairs) need 66 2/3% approval. Assessments become a personal debt and a lien on the lot if unpaid.
- Lake usage & restrictions: The lake is for private enjoyment of owners only. No drawing water, no dumping or pumping into the lake, and no boats except those owned by owners. Owners must maintain a 20-foot maintenance easement around the shoreline and keep vegetation within 20 feet of the original shoreline trimmed. Fences within 10 feet of the shoreline or blocking lake views are prohibited unless they are wrought iron or approved.
- Maintenance responsibilities: The association maintains common property (including lake easements, landscaping, etc.). Each owner must maintain their lot's landscaping and portion of the lake shoreline. Lot 28 has sole responsibility for maintaining fountains, spillways, and stone walls on that lot. The association can perform maintenance at owner expense if owners fail to comply.
- Solar energy devices & rain barrels: Solar devices require pre-approval, must be roof-mounted on the back side (or in a fenced yard), and must match the roof slope. Solar shingles must resemble customary shingles. Rain barrels/rainwater systems also require pre-approval, cannot be in front yards or common areas, and must match the home's color scheme.
- Religious displays: Owners may display religious items on their entry door or doorframe subject to sincere religious belief, but items cannot threaten safety, violate law, or contain patently offensive content. The association may remove violating items without prior notice.
- What this document doesn't cover: This declaration does not address leasing/rental restrictions (no minimum lease term, no rental caps), pet limits (no mention of pets), age restrictions (no 55+ requirement), or parking/vehicle rules. Those subjects may be covered in other governing documents for the broader Brook Meadows Addition or by the City of Colleyville.
