What Brook Meadow Property Owners Association, Inc.'s governing documents say
This is a narrow, ancillary declaration of covenants, not a full HOA rulebook, between a specific property owner and the Thornbury Homeowners Association about one large cottonwood tree near a shared wall/fence easement. It applies only to the Burdened Property described in the document, not to the whole Brook Meadow community. Homeowners or buyers should not treat this as the community's general governing rules.
- Tree maintenance & removal: The property owner must maintain the tree so it doesn't damage the HOA's wall or fence, and must immediately remove the tree at their own expense if it becomes diseased or poses imminent damage.
- Repairs after damage: If the tree damages the wall or fence, the owner must fully repair it within 30 days of written notice (or diligently pursue repairs to completion).
- Indemnification: The owner agrees to indemnify and hold harmless the HOA and its representatives from all losses, damages, and attorneys' fees caused by the tree.
- HOA self-help & lien rights: If the owner fails to perform required work, the HOA may enter the property to do the work and may place a lien on the Burdened Property for costs, expenses, and interest at up to 8% per annum.
- Enforcement: The HOA and owners of the Benefited Property can enforce the covenants through court action, including injunctions and damages, and the prevailing party can recover litigation costs and reasonable attorneys' fees.
- Binding effect: The covenants bind and benefit all successors and assigns who have any ownership interest in the Burdened Property or Benefited Property.
- What this document doesn't cover: This document is only a limited tree-related covenant between two parties. It does not contain general HOA rules, assessments, architectural restrictions, pet rules, leasing rules, or any other community-wide governing requirements.
