Diamond Creek is a single-family home subdivision in Forney, TX, governed by a homeowners' association (HOA). These documents are supplements and amendments to the original CC&Rs, not the full governing document. The rules bind all homeowners in the community.
- Garages: Each home must have a minimum two-car garage. Garage doors must remain closed when not in use, and garages cannot be converted to living space without city and architectural committee approval.
- Fences & structures: Fences may be up to 8 feet tall. Accessory structures (sheds, etc.) are limited to 100 square feet and must not be visible from a public street.
- Architectural review: Plans for exterior changes must be submitted to the Architectural Control Committee. The committee has 30 days to approve or disapprove; if no response within 30 days, plans are deemed approved.
- Assessments & fees: Regular assessments are due within 30 days of invoice. The association may suspend an owner's right to use common areas for nonpayment or for rule infractions. The board can also require deposits or fees for use of common areas.
- Owner hearing rights: Before fining an owner or charging for property damage, the association must give notice and provide a hearing within 30 days of the owner's written request. Owners may appeal committee decisions to the board.
- Amendments: The developer (Declarant) may unilaterally amend the CC&Rs for purposes like complying with law, satisfying lenders, or correcting errors. Otherwise, amendments require approval of 51% of all members plus developer consent while developer owns a lot.
