These are the Bylaws of Vista Point HOA, Inc., a property owners association (POA) in Johnson County, Texas. The document governs how the association is run—covering board elections, meetings, rule-making, and member obligations. It applies to all lot owners in the Vista Point subdivision and does not itself list use restrictions (like pets or leasing) which are in the separate Declaration.
- Membership & voting: Every lot owner is a member with one vote per lot. During the Declarant Control Period, the developer (Class B member) gets nine votes per lot. A 10% quorum is required for member meetings.
- Board of Directors: The board has three directors elected by members. After the Declarant Control Period, directors serve staggered three-year terms. Co-owners of a single lot cannot both serve on the board at the same time.
- Meetings & notice: Annual member meetings are required. Notice of board meetings must be given at least 72 hours in advance (by posting, email, or mail). Special member meetings can be called by petition of 10% of eligible votes.
- Rules & regulations: The board can adopt, amend, or repeal rules on property use, maintenance, and resident welfare. At least 10 days' notice must be given to owners before a rule takes effect, and owners may comment.
- Owner obligations & enforcement: Owners must provide proof of ownership upon request. The board can fine for violations after notice and hearing, and may suspend common area use for rule-breaking.
