Trailwind Residential Community is a single-family home HOA in Mesquite, TX. You own your lot, and the association owns and maintains common areas. This Community Manual includes the association's bylaws, collection policy, and other governance rules that bind all owners and residents.
- Board of Directors & Developer Control: The board initially has 3 directors appointed by the developer (D.R. Horton). After 75% of lots are sold to non-developer owners, one director is elected by members; the developer continues to appoint two-thirds of the board until the development period ends. Directors serve without pay.
- Voting & Meetings: Each owner gets one vote per lot. Annual meetings are required; quorum is 10% of total votes. Proxies are allowed for a single meeting and expire after 11 months. Absentee and electronic ballots are permitted. Recounts can be requested at the member's cost.
- Assessments & Collection Policy: Regular assessments are due on the first of the month. Late fees of $25 are applied at 30, 60, 90, 120, and 150 days past due. The association may add collection fees and attorney fees. Delinquent accounts may be turned over to a collection attorney after 150 days.
- Amendment Process: The Certificate of Formation can be amended by the developer during the development period or by a majority of the board with developer approval. After the development period, the board may amend the bylaws and community manual by a majority vote.
- Dissolution: The association may be dissolved by a vote of at least 90% of the total votes. Remaining assets must be dedicated to a public agency or similar nonprofit organization.
