Hampden Woods is a single-family-home HOA in Fort Worth, Texas. This document is a 2020 amendment that adds detailed rules about leasing your home. It was adopted by the board and at least 51% of owners, overriding an earlier Texas law default of 67% because the declaration allowed a lower percentage.
- Leasing & rentals: Lots may be leased only for residential purposes, for a minimum term of 12 consecutive months. No hourly, daily, weekly, or monthly rentals allowed; no short-term/vacation rentals. You must lease the entire lot; rooms or fractions cannot be leased without board approval. Only one lease per lot per term is permitted.
- Rental approval & paperwork: You must get the board's written consent before leasing, though permission won't be unreasonably withheld if all requirements are met. You must provide the association a completed tenant information form (if available) before the tenant moves in. Both you and the tenant must sign acknowledging the tenant will follow all HOA rules.
- Who is a tenant: A tenant is anyone living in the home who isn't the owner or the owner's spouse, partner, parent, child, sibling, grandparent, grandchild, etc. The board decides who counts as a tenant.
- Tenant compliance & owner liability: If a tenant violates HOA rules, the owner must correct it. If the owner can't or won't, the HOA can enforce the lease and even evict the tenant. The owner is liable for all enforcement costs, which become a lien on the property.
- Subletting & lease extensions: Subletting or assigning a lease is prohibited without prior board approval. The board can block a lease extension if a tenant has caused serious rule violations.
- What this document doesn't cover: This is only an amendment adding leasing rules. It does not cover other HOA rules like architectural review, parking, pets, assessments, or maintenance responsibilities. The original declaration (from 1995) and any other amendments still apply.
