What Shelby Street Townhouses City's governing documents say
Shelby Brown Condominiums is a small condominium community in Garland, TX — you own your individual unit and share undivided ownership of the common elements. The association maintains common areas, carries master insurance, and collects assessments from unit owners. Because there are only three units in a single building, the rules emphasize shared responsibility and limited common elements like assigned parking and patios.
- What you own & maintain: You own the interior of your unit (walls, floors, ceiling, fixtures); the association maintains common elements (building structure, common areas) and limited common elements (assigned parking spaces, patios, balconies). Each unit carries a Percentage Interest in the common elements used to calculate votes and assessments.
- Assessments & fees: All owners must pay annual and special assessments. An initial working capital contribution of $350 is due upon purchase. Assessments are based on each unit's Percentage Interest. Delinquent assessments accrue interest, late charges, and collection costs, and become a lien on the unit.
- Right of first refusal on sale or lease: The association has the right to match any offer to sell or lease a unit. If you want to sell or rent, the association may buy the unit instead. This applies to both sales and leases, with certain exceptions.
- Limited common elements: Each unit is assigned specific limited common elements: a parking space (shown on the plat) and a back yard patio or balcony. These are for the exclusive use of that unit's owner and cannot be reassigned without consent.
- Insurance & damage: The association carries master property and liability insurance for the building and common elements. Unit owners must insure their own interior improvements. After a casualty, the association handles repairs and may levy special assessments if insurance proceeds are insufficient.
- What this document doesn't cover: This declaration does not specify pet limits, age/occupancy restrictions, rental term minimums, or architectural review procedures. Those rules may appear in separate association bylaws or rules and regulations (not provided).
