This is the Bylaws of Higher Links HOA, Inc., a Texas nonprofit corporation governing a single-family residential subdivision of 49 lots (and one common lot) in Godley, TX. - Document type & community: These Bylaws govern a standard single-family HOA (not a condo or townhome). Each lot owner is a member. The rules in this document apply to all lot owners, residents, and lessees.
- Board of Directors: The Board has 5 directors elected by the members. Terms are staggered: initially, the top 3 vote-getters serve 2 years, the next 2 serve 1 year; thereafter all terms are 2 years. Directors may serve consecutive terms. Vacancies are filled by a majority of remaining directors.
- Member meetings & voting: An annual meeting is required. Quorum is 20% of members entitled to vote. Voting may be in person, by proxy, absentee ballot, or electronic ballot. Each lot has one vote; co-owners must agree on one vote. There is no cumulative voting.
- Election procedures: Elections are held by written ballot. Candidates must be solicited at least 10 days before ballots are distributed. A recount can be requested within 15 days of the election, paid for by the requestor (refunded if outcome changes). Only neutral persons may tabulate votes.
- What this document doesn't cover: These Bylaws contain no rules about leasing, pets, parking, architectural standards, assessments, or fines. Those restrictions would be in the separate Declaration of Covenants, Conditions, and Restrictions and/or Rules & Regulations.
